I. General      

The following are the terms and conditions of The BlowFish Branding Co. (hereinafter also referred to as "our company", “BB Co.”, and “we”). Any variations, including special terms and conditions, shall be inapplicable unless documented on your invoice. We shall be entitled to alter these Terms and Conditions at any time, but this right shall not affect the existing Terms and Conditions accepted by the Buyer upon making a purchase. Any purchase or renewal of services will be subject to our then current Terms and Conditions. Please refer to your invoice for specifics regarding your particular marketing campaign. If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

The BB Co. will always try to accommodate our clients however, we reserve the right to refuse service to anyone, at anytime, for any reason. Payment for any services or products must be made in full prior to the start of any project. No refunds of any kind will be issued unless stated in writing by our company. You understand that our company is not responsible for interruptions or failures in services provided by partners or affiliates. The BB Co. shall perform the services with reasonable skill and care. We may have to suspend services for repair, maintenance, or improvement. If so, we will restore them as quickly and reasonably possible.

II. Access                                                                                                                                                                                                                                   Your access to and use of www.blowfishbranding.com and www.blowfishbranding.net ("the Websites") is subject exclusively to these Terms and Conditions. You will not use the websites for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the websites you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the websites. The content of our websites do not constitute advice and should not be relied upon in making or refraining from making, any decision. The websites may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such site.  

III. Copyright   

All Creative works of the BlowFish Branding Co. are protected. BB Co. is not liable for any content used in your marketing. You acknowledge that you are authorized to use ALL content provided to us and assume full legal responsibility for said content. You authorize our company to use any creative work including artwork and pictures in any manner we choose. You also understand our logo and/or company name may appear on marketing produced.

IV. Web Projects                                                                                                                                                                                                                            U sing the information gathered, we will construct your website, and send updates as the project progresses. NOTE: UNLESS YOU PURCHASE COPY SERVICES OR OTHERWISE AUTHORIZED ON YOUR INVOICE,  YOU MUST PROVIDE ALL CONTENT TO BE PLACED ON YOUR SITE VIA CD, FLASH/USB DRIVE, OR ZIP FOLDER IF EMAILED. PLEASE INCLUDE THE NAME WE GIVE YOUR PROJECT IN THE SUBJECT LINE TO ENSURE PROPER CONFIRMATION THAT WE RECEIVED YOUR FILES.

Unlimited updates are available for CLIENT PROVIDED PICTURES AND TEXT CONTENT ONLY! Once your website has been published online, any other changes including graphic design will be charged based on the request. Completion of change requests typically take 3-5 business days, but can vary depending on the nature of request and our company’s current workload

Renewal service fees include the updates as described above, hosting, domain support and must be paid in order to keep the site live and operational. There may be additional fees applied if thee is a lapse in payment.

You can cancel anytime without fees, but must notify us in writing at least (30) days before your last day of service. Source files for your web project are available on CD for an additional $1000.

V. Artwork & Designs

We will create up to (3) mock-up designs for any logo, print product, or other artwork. You can also (2) sets of changes to whichever design is chosen. Additional fees may apply if more designs are requested.Typical turnaround on designs is 3-7 business days, but can vary depending on nature of request, and our company’s current workload. Typical turnaround on printed materials is 7-14 business days, but can vary.

VI. Photography                                                                                                                                                                                

Thirty (30) minutes of travel time is included in session charges. We try to accommodate most schedules, however additional fees may apply to sessions requested that require travel outside this distance or through  “rush hour” traffic. Modification, enhancement, and/or altering of photos is quoted per project based on the nature of request. Your final photos will be presented to you on CD.
